Terms and conditions for using FunShot's AI-powered product photo generation platform.

1. Acceptance of Terms

By accessing or using FunShot ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including free tier users and paid subscribers.

2. Service Description

FunShot is an AI-powered product photo generation platform that enables e-commerce sellers to create product images from uploaded reference photos and text descriptions. The Service is an independent platform that provides access to third-party AI image generation models through a custom interface.

3. Account Registration

To use the Service, you must:

• Create an account using Google Sign-In
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 18 years of age or have parental consent

You are responsible for all activity that occurs under your account.

4. Prohibited Content & Use

You expressly agree that you will NOT use the Service to generate, upload, or distribute:

• NSFW content including nudity, sexual acts, or sexually suggestive material
• Explicit or pornographic content of any kind
• Sexually suggestive or provocative imagery
• Violent, hateful, or harassing content
• Content that infringes on third-party intellectual property rights
• Deepfakes, face-swaps, or non-consensual image manipulations
• Content depicting illegal activities
• Content depicting minors in any inappropriate context

Violation of this section constitutes a material breach of these Terms and will result in immediate account termination without refund.

5. Content Moderation

All image generation requests are subject to automated content moderation. Content that violates our Acceptable Use Policy or these Terms will be blocked from generation. FunShot reserves the right to review, monitor, and remove any content generated through the Service at its sole discretion.

6. Subscriptions & Payments

6.1 Plans

The Service offers free and paid subscription plans. Paid subscriptions are billed monthly or annually as selected at checkout. All payments are processed by Creem, our Merchant of Record.

6.2 Credits

Image generation consumes credits based on resolution and quantity. Credits are replenished monthly according to your plan. Unused credits do not roll over to the next billing period.

6.3 Refunds

All payments are non-refundable except as required by applicable law. You may cancel your subscription at any time, and access will continue until the end of the current billing period.

6.4 Price Changes

We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing period.

7. Intellectual Property

7.1 Your Content

You retain all rights to the images you upload to the Service. By uploading images, you grant FunShot a limited license to process and store those images solely for the purpose of providing the Service.

7.2 Generated Images

Subject to compliance with these Terms, you own the rights to images generated through the Service. FunShot makes no claim of ownership over generated outputs.

7.3 Service IP

The FunShot platform, brand, logo, and underlying technology are the exclusive property of FunShot and its licensors. You may not reproduce, modify, or distribute these materials without prior written consent.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FUNSHOT DOES NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED IMAGES WILL MEET YOUR SPECIFIC REQUIREMENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNSHOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. IN NO EVENT SHALL FUNSHOT'S TOTAL LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU TO FUNSHOT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Termination

FunShot may terminate or suspend your account at any time for violation of these Terms, our Acceptable Use Policy, or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
